The proposed settlement of Homezeller’s antitrust claim against independent real estate broker Sibcy Cline passed the first round in federal court.
In an order on February 11th, US District Court Judge Stephen R. Bow for the Western District of Missouri gave preliminary approval to the transaction, finding it to be “fair, reasonable and appropriate.” .
On February 6th, the plaintiff filed an appeal for preliminary approval of the proposed settlement of the suit the following day in order to amend the complaint in a relatively new committee suit known as Kiel after the leading plaintiff. .
Sibcy Cline has more than 1,000 agents in Ohio, Kentucky and Indiana. The agreement will pay Ohio-based Sibcy Cline $895,000, with a total keel settlement fund of $11,465,000.
Other companies appointed as defendants in the case include Side, Washington Fine Properties, Seven Gables Real Estate, First Team Real Estate – Signature Properties in Orange County and Huntington. The settlement proposed to these companies was brought to court on January 27th, and the transactions were approved in advance on February 4th. This lawsuit was approved by the court. ”
The proposed settlement covers the same settle class as other transactions. Next date range: October 31, 2019, date for class notifications. ”
In order Tuesday, Bough revealed that it includes people who sold their homes on MLS nationwide, regardless of their partnership with the National Association of Real Estate.
The court is scheduled for a final approval hearing on the settlement of the Kiel case in the center at 2:30pm on June 24th. The same court will hold a final approval hearing on the same day in Gibson, a similar case, at 1:30pm in the central area.
Sibcy Cline president and CEO Robin Sheakley did not respond to a request for comment.
