There are many committee litigation, but the litigation submitted last week was unusual.
This case, which is now known as a keel for major defendants, is worth noting. This is because, unlike other litigation, which led to several months or several years, the proposed settlement was submitted on the same day as the complaint.

Inman wanted to know more, so I contacted Harrington to seek a conversation for her company about the reason for reconciliation and what was happening in the industry. This conversation is more noticeable in Harrington’s frankness and larger than most Indian, but as a leader in a large regional company smaller than mega farms such as Keller Williams and Compasses. did.
The point from this conversation is that Harrington and her, other people like her, are not satisfied with the methods of the committee’s lawsuit. In particular, she has been criticized by the National Real estate agent association, and other medium -sized brokers also feel uncomfortable. Harrington has urged leaders in other industries to speak to protect the industry.
“I have to protect it,” she told Inman, “It will be gone.”
The following is a version of Inman’s conversation with Harrington, edited for length and clarity.
Inman: Tell me about your company for unfamiliar people before entering the committee. Where do you operate and how big?
Michele Harrington: We are in Southern California and a 48 -year -old company. We are the largest private in California. There are 2,000 agents. We sell $ 6 billion and are currently growing.

It was really the ability to pay a kind of thing. And we have come out from a really bad year in real estate. We had it [Telephone Consumer Protection Act] Class action two years ago. Last year, I was attacked. Therefore, we are struggling considerably from these random acts, cyber attacks, and collective lawsuits. And it’s really terrible, and there’s nothing we can control.
So I think we negotiated a decent reconciliation. I want to say it for our scale. But that’s still, as I said. I still smoke.
Cyber attacks were useless in control. TCPA had the same kind of money. This all needs to return to a securities company and eliminate millions of dollars. Therefore, it is difficult to operate a securities company if you do not have billions of dollars, such as a compass or a Berkshireha Saway.
These recent years have been the most difficult year in our lives as a securities company.
Talk to me like an economic burden. You may think that you are a large company, but I don’t think this hurts. But do you get a feeling that may not be so?
It is far beyond the cost of business. We call it a local player, an independent one. You are always filing an annoying lawsuit. For years, buyers buy a house where the seller did not tell them anything. They are expected and the cost of doing business.
However, these group measures are not the cost of doing business. And have two people in two years.

A group litigation was set for someone to poison water. Like a factory, water and the whole town get cancer. As you know, you have to immerse yourself and DIP to arrange these greedy lawyer pockets. I don’t think the story has been told. Most people don’t even know that NAR excluded these brokers.
What did you think when NAR’s reconciliation is not covered by your company or other companies?
I was angry and I am still angry. We pay NAR membership fees, as everyone else is. Support NAR. There are 2,000 agents paying NAR every year. We will do it so that they can stand up for us. And they excluded us. Like “screw -in”. oh my god. I was very angry.
Some people were very angry. We talked about NAR’s appeal. We talked about chasing them and chasing them about excluding us. At first there was a meeting. Everyone was alive.
You say you talked about the lawsuit, but it seems to have opposed it. why?
In the room, there was a strong condition of a broker who was very stubborn to sue NAR. But they were not enough. And I don’t know, it may still happen. Not off the table.
Many of these brokers have not yet been solved. So when they settle down and cause true damage, they are still on the table.
NAR came out and said, “This is the best transaction we can get. For various reasons we could not include all people. We have to reduce transactions. I didn’t think of those comments?
No, I personally had a conversation with them. Because when this came out for the first time, I was quite loud about it. And they explained to me that this is the best thing we can do.
No, it wasn’t the best they could. NAR is a non -profit organization and a welfare organization. If they have to declare bankruptcy, if they have to take care of them, they have to dissolve them so that they can pay all these villages is. They are not there for their own existence. They are members’ welfare organizations. They are in us for us.
What they did is obviously for them. When I talked to them, I told them that there were these 80 regional brokers, and they acted as if we did not realize we existed. And if you try to exclude someone, you may have excluded a publicly traded company.
They may have said, “OK, we intend to cover everyone except the public companies.” Shareholders pay it because they are shareholders. However, it was terrible to avoid private companies.
In the future, do you envision the future, which is part of NAR?
The reason I think NAR is important is that I need lobbyist. One of the ways they think they had dropped the ball seriously was when the elections appeared at the same time as the reconciliation, and we knew there were elections. The two are running for President Lobby. Ask, “If we support you, will you remove DOJ from our back?”
If we put pressure, we were able to release DOJ from our back, but we do not want to participate in the presidential election. I get it. There is a reason, but there is no need to choose a candidate. You can support both candidates, and both must protect the Ministry of Justice from our business.
They have a lot of money and a lot of power, but they are afraid to use them. I’m not afraid, and if there is another organization that actually spends the money they have, I will participate in the organization because the lobby activities for us are really important.
I understand what you are saying about suits and Naru. However, I am also wondering about the new rules and the agent’s experience on the ground. Is the situation worse, better, or the same? What is the new normal?
We did a lot of training very early. Therefore, our agents were very familiar with what they needed. We were worried that the buyer’s committee would decrease. I haven’t seen it yet.
I think very experienced agents will hold their own. They are trying to get what they feel worthy of. And a good agent will probably get more if the listing agents have gained what they have gained.
It’s a bit good if it’s a bit good. All this money, all this effort, and it didn’t change.
What if other leaders in the industry have one message in the future? What do people need to hear at this point?
We need to be more vocals, and when we see this happening, we need to speak out. The industry is unfair and harmful to the industry. We need to protect the industry that we gave.
I have reached the place where I am from the Marine Corps. I want to be able to have a great career that helps people who graduate from college or graduate from the army at the age of 23 to help people buy a dream house. It is a wonderful industry. It’s a great career.
If we do not protect it, it will disappear. You need to get up. We need to speak. You need to make sure you are focused on the important part of the industry. Don’t be quiet and don’t care if you don’t like what you have to say. Someone has to say that.
