The months-long battle between the National Association of Realtors and Phoenix realtors appears to have ended Thursday after agreeing to abandon the controversial membership option.
In a statement, NAR said the Phoenix real estate agent has agreed to withdraw its MLS choice. In doing so, the statement will bring Phoenix real estate agents to adhere to the NAR rules and allow the association to maintain its charter. Instead of MLS selection, Phoenix Realtors offers another offering called “non-member MLS access.”

The Phoenix Realtors announced their MLS choice for the first time last fall. The idea was to offer a new membership level at a cost of $249 a year. This allows agents to access state-compliant forms, legal assistance, etc., but does not require participation in the NAR or state real estate association. .
The announcement of the MLS choice has pressured real estate agent organizations to decide whether to change the so-called “three-party contract,” and NAR policy has stated that “local, state and national real estate agent organizations are Request a “NAR policy” to use “” to request that you be a member. “Real estate agent” title. For months after the outbreak between NAR and Phoenix real estate agents broke out, the tripartite agreement has remained one of the most debated issues in the real estate industry.
In December, NAR sent a letter to Phoenix real estate agents to suspend and repeal that threatened legal action if they advanced their MLS options. Phoenix real estate agents have stepped back and regained their recourse by saying they would not refer to their MLS choice as “both legally sound and responsible provision to a changing industry.” In a statement Thursday, Phoenix real estate agents added that NAR has begun a process to cancel the charter amidst the conflict, with the issue being concerns about weakening and disruption of the real estate agent brand.
Thursday’s announcement reveals that the two organizations have finally reached a compromise.
According to the statement, the new “non-member MLS access” offering is offered “eliminate further confusion” and does not provide users with access to the “Real Tarter” title. However, the non-member option will allow non-realters to access multiple listing services (ARMLS) in the Arizona area, providing some products and services. Phoenix Realtors has been offering services that provide non-Realtors ARMLS access since 1996, according to a statement.
In a statement, NAR said the issue “is not about MLS access and the NAR policy regarding this has not been changed.” He also said, “We are pleased to have reached this resolution protecting strict standards for real estate agent brands.”
Phoenix real estate agents described the resolution as “a mutually beneficial agreement that ensures that non-membership recruitment of Phoenix real estate agents complies with NAR’s constitution, ordinances and three-way contracts.”
“Phoenix real estate agents continue to be committed to the benefits, three-way contracts and benefits possible through the relationship between the Phoenix Association, the Arizona Realtors Association and the NAR,” the statement adds. “The results support the Phoenix Realtarters and NAR’s ultimate goal of helping members of real estate agents succeed and thrive in the larger real estate industry.”
