TUCSON, Ariz., Oct. 22, 2024 (Globe Newswire) — The American Association of Physicians and Surgeons Educational Foundation (“AAPS”) on Monday filed an expanded federal lawsuit against the Biden administration and board-certified organizations that have threatened it. Doctors’ academic accreditation may be revoked or revoked based on their outspokenness on public policy issues.
For example, doctors who advocated the use of ivermectin to treat COVID-19 have faced retaliation by having their medical licenses revoked. Additionally, the amended complaint states that committee-certified witnesses testifying against abortion in Congressional hearings were threatened with retaliation for their committee certifications.
The lawsuit also includes three doctors who were victims of such retaliation.
“Using nearly identical language and timing, Defendants acted in a manner clearly coordinated to achieve a common goal of viewpoint-based censorship,” AAPS said in its amended complaint. Obstetrics and Gynecology (ABOG), American Board of Family Medicine (ABFM), Biden Administration.

In this precedent-setting lawsuit, AAPS establishes that ABIM, ABOG, and ABFM engaged in “state action” to threaten or revoke the medical board certifications needed to practice medicine at most hospitals. I’m trying. Because these board-certified organizations should be considered state actors, the First Amendment prohibits them from discriminating on the basis of viewpoint.
“This new form of censorship is more dangerous than previous violations of free speech,” said AAPS attorney Andrew Schlafly. “The Biden administration is also unfairly forcing social media platforms to remove posts and videos. “It was.”
The U.S. Court of Appeals for the Fifth Circuit ruled on June 3 that there was a constitutional hearing right fully protected by the First Amendment in this case. “For physicians to be silenced by the threat of having their certification revoked violates their constitutional right to be heard,” Schlafly added.
The AAPS Educational Foundation’s lawsuit is pending in U.S. District Court in Galveston, No. 3:22-cv-240.
The American College of Physicians and Surgeons Educational Foundation sponsors the conference and provides grants for student attendance.
